4. Purpose of the Data File

The processing of personal data is, with regard to the general prerequisites for processing, based on section 8, subsection 1, paragraphs 1, 2, 5 and 7 of the Personal Data Act (523/1999).

The data in the customer and visitor data file is used for the direct marketing and sales of the Cuckoo Workout service. The data is processed to monitor visitor activity on the website and how visitors end up on the website as well as for sales performance monitoring and possible customer profiling for sales purposes. The data is also used for customer service in a situation where a user contacts Cuckoo Networks Oy’s employees through the chat service or contact form on the website.

5. The content of the Data File

The following data is collected regarding visitors based on their visit:

  • Browser information, such as IP address, name and version number of browser, name and version of the operating system
  • Opened pages
  • Possible referrers through which a visitor has come to the website

The following data is collected through online forms:

  • Identification data for persons, such as name, company name, email and telephone number

The following data is collected through the Intercom communication tool:

  • Unique identifier for conversation participant
  • Conversation process and messages
  • Browser information, such as IP address, name and version number of browser, name and version of the operating system

By using and disclosing data on the Cuckoo Workout website, you accept the processing, recording and disclosure of your personal data as described in this document.

6. Regular Sources of Data

Data is generated in the data file based on the data subjects’ own disclosures and employers’ disclosures and through the controller’s own activities (service fee data). If necessary, the data will be verified from the population information system or similar sources.

The collection of data is carried out using the available online technologies, third-party services and as a result of the visitors’ own activities.

The technologies and services used for data collection are Google Analytics, Google Adwords, Google Search Console, Leadfeeder, tracking cookies, Intercom and online forms.

7. Regular Destinations of Disclosed Data

The personal data provided through online forms is stored and processed in a third-party service, pipedrive.com, which we use for monitoring the sales situation, history and development and improving our customer service. The following data is disclosed to the Pipedrive service: email, name, company name and telephone number. Data is also disclosed to a third party service, mailchimp.com, which we use for sending newsletters and marketing messages. The following data is disclosed to the MailChimp service: email, name, company name and telephone number.

Conversations on our website are carried out through the Intercom service. We will not separately disclose data to the Intercom service. The data collected by Intercom has been detailed under “Content of the Data File”. The persons processing personal data in these third-party services are Cuckoo Networks Oy’s employees.

We never sell or disclose our visitors or customers’ data to third parties for marketing purposes. We may, however, partly outsource the processing of data to a third partly, in which case we will ensure through binding agreements with the service provider that personal data will be processed in accordance with the Personal Data Act and our guidelines.

8. Transfer of Data Outside the EU or the EEA

The Pipedrive service operates in the United States and records data outside the EU and the EEA. Pipedrive does not process, use or maintain any data owned by customers and thus does not have the responsibilities of a processor with regard to data owned by customers. The MailChimp service operates in the United States and records data outside the EU and the EEA. MailChimp is committed to complying with the provisions of the EU/Swiss-U.S. Privacy Shield Framework when processing personal data. Further information at https://mailchimp.com/legal/privacy

The Intercom communication tool used on the website operates in the United States and records data outside the EU and the EEA. Intercom is committed to complying with the provisions of the EU/Swiss-U.S. Privacy Shield Framework when processing personal data. Further information at https://www.intercom.com/security

We only transfer user data for the purposes and to the extent, it is necessary to ensure customer service and sales. The data to be transferred has been specified under “Regular Destinations of Disclosed Data”.

We always comply with the provisions of the applicable law when transferring data. We ensure an adequate level of data protection, for example, by agreeing on matters related to the confidentiality and processing of personal data as required by legislation.

9. Security of Data File

Manual material

Cuckoo Networks Oy does not process or record any material manually. Any reports that are taken from the information systems and contain personal data will be processed and disposed of in accordance with Cuckoo Networks Oy’s data security policy.

Data processed with IT methods

We take the necessary technical and organizational measures to protect the users’ personal data against unauthorized access or processing.

Within the organization, access to visitor and customer data requires separate rights. Access to the data in the third party services, Intercom, MailChimp and Pipedrive, has been prevented from anyone outside of the organization. Within the organization, access to this data requires separate rights.

10. Location data

Rough location data of the visitors’ devices (city/town and country) may be collected automatically through the third party services being used.

The collected location data may be disclosed to third parties as described in this document in order to ensure customer service and sales.

11. Cookies

Our website uses cookies to monitor visitor behaviour. Cookies are small text files sent to and stored on the user’s computer. We monitor how the users end up on our website, how long they spend on our website and which pages they view.

We also use third party cookies on our website to enable the use of third-party extensions. These cookies are set by Google Analytics, YouTube, Google Search Console and Google Adwords. You can disable third-party cookies on your browser if you do not want a third party to collect data about you. In this case the operation of the website may be limited and certain functions may be unavailable.

12. Information to Data Subject

The data subject has been informed, at the time of concluding an agreement, that personal data regarding oneself will be recorded and maintained by Cuckoo Networks Oy. 13. The right of Access and Implementation of Right of Access

In accordance with sections 26-28 of the Personal Data Act, an individual has the right to inspect their personal data recorded in Cuckoo Networks Oy’s customer data file. We do not collect individually identifying data about our website visitors and thus it is not possible to access such data.

Visitors who have provided data through our online forms have the right to inspect the personal data recorded. Requests must be submitted in writing by email to info@cuckooworkout.com. The customer must provide the following details required to carry out the search: first and last name and personal identity code.

14. Corrections

Cuckoo Networks Oy’s customer can add to and correct the personal data recorded. The customer can add to their data and update their contact details through Cuckoo Networks Oy’s online service, in accordance with section 29 of the Personal Data Act. Requests to correct data other than contact details must be submitted in writing to Fredrikinkatu 34 B26, 00100 Helsinki, Finland or info@cuckooworkout.com. Visitors can also request the removal of their data if the collected data is inaccurate, unnecessary or incomplete and the legislation does not impose a legal obligation to store the data in question.

The customer must provide, in writing, the following details required to correct the data: name and personal identity code.

The correctness of the data will be verified from the population information system. The persons in charge of the data file are primarily responsible for correcting the data. The customer can only correct their own contact details.

15. Right to prohibit processing

In accordance with section 30 of the Personal Data Act, the data subject has the right to prohibit Cuckoo Networks Oy from processing personal data for the purposes of direct marketing, distance selling, market research or opinion polls. The prohibition request can be submitted through the website, by email to info@cuckooworkout.com or in writing to Fredrikinkatu 34 B26, 00100 Helsinki, Finland.

The customer must provide the following details to implement the prohibition: name and personal identity code.
